PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to iissue a Writ of Mandamus directing the fourth respondent to survey the land in T.S.No. 1589/1, measuring an extent of 8 cents of land situated at Madura Town Survey Ward 5, Corporation Old Ward 8 and New Corpoation Ward No.30, Madurai Souh Registration District and consequently, to direct the fifth respondent to give adequate police protection for survey of the land based on the representtion given by the Petitioner,dated 12.4.2025.

O R D E R

The Petitioner herein seeks a direction to the fourth respondent to survey the land in T.S.No.1589/1, measuring an extent of 8 cents of land situated at Madura Town Survey Ward 5, Corporation Old Ward 8 and New Corpoation Ward No.30, Madurai Souh Registration District and consequently, to direct the fifth respondent to give adequate police protection for survey of the land based on the representtion given by the Petitioner,dated 12.4.2025.

2.According to the Petitioner, he purchased 8 cents of land in the above survey number from Dilsath Begum by way of registered sale deed, dated 22.7.2024 and has been in possession and enjoyment of the same. The Petitioner submitted an application for survey of the property on 17.3.2025 and paid the necessary fees for survey. Inspite of the same, no steps have been taken by the respondents for survey of the subject property. Therefore the Petitioner submitted a representation, dated 12.4.2025 for survey of the above said land as per the application. The same has not been considered by the respondents and hence the Petitioner has come forward with the present Wri Petition for the relief stated supra.

3.The learned Additional Government Pleader who takes notice for the respondents 1 to 4 would submit that the fourth respondent has received an objection from the fifth respondent and hence, the representation submitted by the Petitioner will be considered in accordance with law within the time limit prescribed by this Court.

4.In view of the same, without going into the merits of the case, the fourth respondent is directed to consider the representation of the Petitioner, dated 12.04.2025 and pass final 3/6

orders on its own merits, after issuing notice to the Petitioner and the sixth respondent , within a period of 8 weeks from the date of a copy of this order.

5.With the above direction, the Writ Petition stands disposed of. No costs.
