Prayer : Criminal Original Petition filed under Section 482 of the Code of Criminal Procedure, to direct the respondents and their subordinate officials not to harass the petitioner and his family members unnecessarily against law under the guise of enquiry. ORDER

This petition is filed seeking a direction to the respondents not to harass the petitioner under the guise of enquiry, on the basis of the complaint given by one Swaminathan, who is not a party in this petition.

2.When the matter is taken up for hearing, the learned Additional Public Prosecutor would submit that based upon the complaint given by one Swaminathan, enquiry was undertaken in CSR No.432 of 2021 and during the course of enquiry, it was found that the parties are claiming right and title over the same property and on that ground recommendation has been made to the Tahsildar, Pattukkottai to enquire the matter under Section 107 Cr.P.C. It is also seen from the arguments of the learned counsel for the petitioner that civil litigation also pending between the petitioner and the said Swaminathan. Hence, the complaint given by Swaminathan was closed.

Crl.O.P.(MD)No.10998 of 2021 3.Recording the aforesaid submission of the learned Additional Public Prosecutor that complaint has been closed, nothing survives for further direction or consideration in this petition. Accordingly, this Criminal Original Petition is disposed of. The petitioner is at liberty to approach the concerned Civil Forum for his remedy.
