ORDER

The petitioner has filed this petition to quash the charge sheet in S.C.No. 38 of 2024 for the offences punishable under Section 294(b) and 307 of IPC pending before the Sub Court, Ramanathapuram District as against the petitioners.

2. The allegation in the Charge Sheet is that due to prior enmity, the petitioners had attacked the defacto complainant with knife and abused him in filthy language.

3. The learned counsel for the petitioners would submit that the allegation in the Charge Sheet would not constitute the offence under Section 307 of IPC; He would further submit that even the Doctor, who treated the defacto complainant has certified that the defacto complainant sustained only a simple injury in his hands.

4. Admittedly, the petitioners and the second respondent are known to each other and they have now entered into a compromise and decided to give a quietus to the entire dispute. The parties have filed a joint compromise memo dated 11th September 2025 and the scanned copy of the compromise memo 2/8

The petitioners, namely, Maheindran Masi (Aadhaar No.6416 1272 2675), Vetrivel (Aadhaar No.2547 0460 7423) and the second respondent, namely, Meganathan (Aadhaar No.8203 2805 1458) are present before this Court in person. They are identified by Mr.Chandrasekaran, Special Sub Inspector of Police, Thirupullani Police Station, Ramanathapruam District. All the parties confirmed the compromise arrived at between them.

In view of the fact that the allegation made in the Charge Sheet would, at best, attract the offence under Section 324 of IPC and considering the nature of the offences and the relationship between the parties, this Court is of the view that no useful purpose would be served by keeping the impugned final report pending trial. Accordingly, the impugned Charge Sheet in S.C.No.38 of 2024 pending before the Sub Court, Ramanathapuram District, is quashed and the Criminal Original Petition stands allowed. 12.09.2025 NCC : Yes / No Index : Yes / No Internet : Yes/ No Indu 6/8
