N1/E-8605954/146/2024 dated 05.02.2025 and quash the same as it is arbitrary and illegal and in consequence direct the respondents to in restore the pay and accordingly to re-fix the pension in accordance with the last drawn pay while in service and to repay the recovered excess amount of Rs. 1,62,357/- and to pay enhanced pension with all the arrears thereon in the light of the order passed by Honble Supreme Court in Whitewasher case reported in 2015(4) SCC 334. When the matter came up for hearing, the learned Additional Government Pleader, appearing on behalf of respondents 1, 3 and 4, upon instructions, submitted that the petitioner has remitted the recovery amount as demanded in the impugned recovery proceedings dated 05.02.2025. In this regard, an e-challan has also been filed along with the writ petition. Therefore, nothing survives for further adjudication in the present writ petition.
