Respondents PRAYER: Criminal Original Petition is filed under Section 482 of Cr.P.C, to direct the first respondent police to withdraw the petitioner's complainant dated 24.04.2021 pending before the respondent No.2 and entrust the same to any other officer not below the rank of Deputy Superintendent of Police for investigation of the complaint based on the petitioner's representation dated 03.08.2021 by this Court.

O R D E R

This petition is filed seeking direction to the first respondent police to withdraw the petitioner's complainant dated 24.04.2021 from the respondent No.2 and transfer the same to some other officer.

2.When the matter is taken up for hearing, the learned Government Advocate(Crl.side) would submit that based upon the complaint given by the petitioner, enquiry was undertaken by the City Crime Branch, Tuticorin. During the course of enquiry, it was found that it is out and out money transaction between the petitioner and some other parties. He would submit that legal opinion was also obtained from the legal adviser. Based upon that it was closed on 03.09.2021.

Crl.O.P.(MD)No.12913 of 2021 3.The petitioner may get a copy of the closure report from the Office of the Public Prosecutor and work out his remedy as per law. Since the complaint has been closed, nothing survives for further consideration in this petition. Hence, this petition is dismissed as infrutuous.
