Writ Petition filed under Article 226 of the Constitution of India, seeking for the issuance of Writ of Mandamus, to direct the 4th respondent to inquire into any document or civil court record from the 5th and 6th respondents regarding their claims and opposition to the petitioner re-laying the underground drainage pipelines in the existing place, where it un-disputably existed during the last 40 years until 14.01.2024, before it was displaced during the ongoing construction of the petitioner's residential building in the Survey No.63 in Ward C, Block 13, Ramanathapuram Town, Ramanathapuram Taluk, Ramanathapuram District to conclude the inquiry as already directed in W.P.(MD)No.28626 of 2024 to enable the petitioner to re-lay the underground drainage pipeline in its pre-existed place. ORDER
The petitioner, with a grievance that his complaints dated 02.09.2024 and 03.09.2024 have not been enquired by the respondent 2/5
Police, has filed this writ petition seeking a direction to the 4th respondent to inquire into his complaints dated 02.09.2024 and 03.09.2024.
2. When this writ petition is taken up for hearing, the learned Additional Public Prosecutor, based on instructions provided to him, submits that the petitioner is having a dispute with his neighbour on removing the drainage and in this regard, he lodged complaints on 02.09.2024 and 03.09.2024. The said complaints were treated as current paper enquiry in C.No.G3/21453/803/2024 dated 02.09.2024, C.No.757/SP-Gri/SDO/RM/2025 dated 02.09.2024, C.No.153/B2PS/RMD/2025 dated 03.09.2024 and the same were also closed. The learned Additional Public Prosecutor has also produced a closure report before this Court.
3. Considering the submissions made by the learned Additional Public Prosecutor, this writ petition is closed with liberty to the 3/5
petitioner to workout his remedy in the manner known to law. The respondent Police is also directed to furnish a copy of the closure report to the petitioner. No costs.
