ORDER

The petitioner has come forward with the present Writ Petition seeking to direct the third respondent to consider his representation dated 20.12.2016 and also to revoke his suspension order dated 07.12.2012, made in D.O.No. 994/2012 C.No.

K1/33229/2012, in view of the judgment dated 13.04.2016, made in Special C.C.No. 04 of 2013, passed by the Learned Chief Judicial Magistrate Pudukottai and to restore the official position of the petitioner with all back wages and emoluments. https://hcservices.ecourts.gov.in/hcservices/

2.The learned counsel appearing for the petitioner would submit that the petitioner was working as a Special Sub-Inspector of Police at Viralimalai Police Station and on account of registration of a criminal case against him, he was placed under suspension by the third respondent. The grievance of the petitioner is that his suspension has not been revoked, despite, he was acquitted from the said criminal case. Since the petitioner's representation dated 20.12.2016 requesting to revoke the suspension order dated 07.12.2012 was not considered so far, the petitioner is before this Court.

3.The learned Government Advocate appearing for the respondents would submit that the petitioner's representation would be considered on merits.

4.Considering the limited scope of the relief sought for by the petitioner in this writ petition, this Court, without going into the merits of the case, directs the third respondent to consider the petitioner's representation dated 20.12.2016 on merits and in accordance with law and also in the light of the judgment dated 13.04.2016, made in Special C.C.No. 04 of 2013, by the Learned Chief Judicial Magistrate Pudukottai, and pass necessary orders after affording due opportunity of hearing to the petitioner, without any delay, preferably, within a period of two weeks from the date of receipt of a copy of this order.
