PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus, directing the 1st and 2nd respondent to permit the petitioner to pay the Additional Current Consumption Deposit of Rs.38,42,612/- alone in 10 equal monthly installments along with the regular current consumption charges.

Mr.S.Deenadhayalan, learned Standing counsel takes notice on behalf of the respondents. By consent of both sides, this Writ Petition is taken up for final disposal at the stage of admission itself.

2. his Writ Petition has been filed seeking for a direction to the respondents 1 and 2 to permit the petitioner to pay the Additional Current Consumption Deposit of Rs.38,42,612/- alone in 10 monthly installments along with the regular current consumption charges.

3.The learned counsel for the petitioner states that due to frequent power cut, production loss and continuous recession in the industry, the petitioner was not in a position to pay the Additional Current Consumption Deposit at once and hence pleads before this Court to pay the Additional Current Consumption Deposit in 10 monthly installments. He would further submit that this Court in similar circumstances, in W.P.No.12954 of 2016 etc. batch has ordered for payment of Additional Security Deposit, in six equal monthly installments, along with current consumption charges and the petitioner herein is also ready and willing to pay the Additional Current Consumption Deposit by way of 6 monthly installments.

4.The learned Standing Counsel appearing for the respondents also agreed for the same.

5. Considering the facts and circumstances of the case and also having regard to the submissions made, this Writ Petition is disposed of directing the petitioner to pay the Additional Current Consumption Deposit of Rs.38,42,612/- 3/5

in six equal installments along with regular current consumption charges, commencing from 16.06.2023, failing which it is open to the respondents to initiate appropriate action in accordance with law.
