ORDER

By consent of both the parties, this Writ Petition is taken up for final disposal.

2. A mere deposit of Earnest Money (EMD) or participation in the earlier tender will not give a right for preferrential allotment. The petitioner is at liberty to participate in the auction which is scheduled to be held on 30.05.2023 for allotment of the shops. Hence, quashing of the tender notice does not require consideration at this stage.

3. Hence, the Writ Petition stands dismissed. There shall be no order as to costs. Consequently, connected miscellaneous petitions are closed.
