For Respondent : Mr.R.Suresh Kumar, Government Advocate (Crl.Side) PRAYER :- To Modify the condition imposed by the Special Court for Exclusive Trail of Cases under POCSO Act, Thoothukudi in Cr.M.P.No.1531 of 2022 dated 06.12.2022 and modify the condition as other than blood surety and own bond of Rs.20,000. ORDER : The Court made the following order :- This petition has been filed to relax the condition imposed on the petitioner in Crl.M.P(MD).No.1531 of 2022 dated 06.12.2022 by the learned Special Court for Exclusive Trail of Cases under POCSO Act, Thoothukudi.

2.The learned counsel for the petitioner submitted that his parent is no more and his relatives are not willing to execute sureties for him. Hence, the petitioner seeks modification of the first condition imposed on him.

3.The learned Government Advocate (Crl.Side) opposes for grant of relief.

4.Considering the nature of offence, the first condition imposed by the learned Special Court for Exclusive Trail of Cases https://www.mhc.tn.gov.in/judis 1/2

CRL OP(MD). No.9529 of 2023 under POCSO Act, Thoothukudi in Crl.M.P(MD).No.1531 of 2022 dated 06.12.2022 is modified to the effect that petitioner shall execute a bond for a sum of Rs.20,000/-(Rupees Twenty Thousand only) with two sureties each for a like sum to the satisfaction of the learned Special Court concerned. The other conditions imposed by the Special Court shall remain unaltered.
