The petitioner has filed this petition seeking a direction as against the respondent Police not to harass him under the guise of enquiry. 1/5

2. Mr.P.Kottaichamy, learned Government Advocate (Crl. Side), takes notice for the respondents and submits that the petitioner is a history sheeted rowdy and he is involved in the following cases. (i) Navalpattu Police Station - Cr.No.129/14 u/s. 107 Cr.P.C.

(ii) Navalpattu Police Station - Cr.No.98/16 u/s.107 Cr.P.C.

(iii) Navalpattu Police Station - Cr.No.500/21 u/s. 387, 506(ii) IPC Trichy city:

Therefore, according to the learned Government Advocate, this is a routine check up to ascertain as to whether he is indulging in any other offence and it is not a harassment.

3. The learned counsel for the petitioner submits that all the criminal cases pending against the petitioner have been closed and he has been acquitted and as on date, he is not having any criminal case. Even then, the respondent Police is harassing him.

4. This Court considered the rival submissions made.

5. Admittedly, the petitioner was involved in several cases, out of which, three cases are murder cases and a history sheet was also opened as against the petitioner.

6. The contention of the respondent Police is that it is only a periodical check up and not a harassment. Law and order is the responsibility of the respondent Police. Therefore, they are expected to verify the present condition of the accused, particularly, a history sheeted 3/5

accused.

7. Recording the submission of the learned Government Advocate that it is only a regular check up and usual verification, this Criminal Original Petition is closed.
