RESPONDENT/COMPLAINANT Petition filed praying that in the circumstances stated therein and in the petition filed therewith the High Court may be pleased to modify the condition imposed by this Honorable Court in Crl.O.P.(MD) No.9856 of 2021 dt.23/07/2021 for the petitioners shall reported before the respondent police at 10.30a.m until further orders.
Order : This petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of Mr.S.SUNDARAPANDIAN, Advocate for the petitioner and of Mr.P.KOTTAI CHAMY, on behalf of the Respondent the Court made the following order:- This petition has been filed seeking to modify the condition of appearing before the respondent Police, imposed by this Court on 23.07.2021 in Crl.O.P.(MD)No.9856 of 2021.
2. The learned counsel for the petitioners submitted that this Court, while granting anticipatory bail to the petitioners, imposed a condition that the petitioners shall appear before the respondent Police, namely, the Sub Inspector of Police, Theppakulam Police Station, Madurai, daily at 10.30 a.m. until further orders. The first petitioner is the daughter-in-law of the defacto complainant. The dispute between the first petitioner and the defacto complainant is a matrimonial dispute. CRL MP(MD) No.5691 of 2021 is now living along with the second and third petitioners at Uthamapalayam. Since the first and second petitioners are having children and due to the pandemic situation, they find it very difficult to travel from Uthamaplayam to Madurai and they are ready to appear before the Uthampalaym Police Station. Hence, they prayed for modifying the Police Station.
3. Heard the learned Government Advocate(Criminal Side) appearing for the State.
4. Considering the submissions made by the learned counsel for the petitioners, the condition is modified to the effect that the petitioners shall appear before the Uthamapalayam Police Station daily at 10.30 a.m. until further orders.
5. Accordingly, this petition is ordered.
