[Order of the Court was made by A.D.JAGADISH CHANDIRA, J.] The present Writ Petition is filed for a writ of mandamus directing the respondents 1 to 3 to transfer the petitioner's son namely Saravanakumar @
Valaipazham Saravanakumar (R.P.No.282), S/o.Mani, aged about 28 years from Central Prison, Trichy to Central Prison, Madurai and admitting him in a 5th respondent's hospital for providing better medical treatment by considering the petitioner's representation, dated 05.06.2024.
2. When the matter is taken up for hearing today, the learned Additional Public Prosecutor appearing for the respondents, on instructions, would submit that the petitioner is an accused in Cr.No.2435 of 2020 for the offences under Sections 8(c) r/w 20 (b)(ii)(C), 29(1), 25 of NDPS Act and 83(ii) JJ Act and he was granted interim bail and during such time, he absconded and he was secured after a period of 7 months. Therefore, the trial Judge has issued the remand warrant and directed the petitioner to be kept at Central Prison, Trichy and if at all the petitioner is having any grievance, he has to approach the concerned Court. He further submitted that the petitioner has made a request for medical tratement and the same was considered and the petitioner is now admitted in Mahatma Gandhi Memorial Hospital, Trichy on 15.06.2024 and he is now under treatment.
3. Recording the submission of the learned Additional Public Prosecutor, this writ petition is closed with liberty to the petitioner to approach the concerned Court seeking to transfer the petitioner's son namely Saravanakumar @ Valaipazham Saravanakumar (R.P.No.282), S/o.Mani, aged about 28 years from Central Prison, Trichy to Central Prison, Madurai.
