PRAYER :- For Bail in Crime No.212 of 2024 on the file of the respondent police 1/5
ORDER : The Court made the following order :- The respondent police registered a case as against the petitioner and other accused in Crime No.212 of 2024 for the offence under Sections 4(1)(aa), 4(1-A) of the Tamilnadu Prohibition Act and Sections 468, 471 and 420 IPC and Sections 5, 6, 8 of the Tamilnadu Rectified Spirit Rules, 2000 and remanded them into judicial custody on 30.03.2024. Therefore, the petitioner has moved this petition, seeking bail.
2.The case of the prosecution is that the petitioner along with other accused has manufactured spurious liquor and selling the same. Hence, the complaint.
3.The learned counsel for the petitioner submits that there is no specific overt act as against this petitioner. However, he is languishing in jail from 30.03.2024. He further submits that the petitioner is ready to pay a sum of Rs.15,000/- to the Panchayat Union Middle School, T.Valayangulam, Kallikudi (Taluk), Madurai District.
4.The learned Additional Public Prosecutor appearing for the respondent opposes for grant of bail on the ground that the investigation is yet to be completed. 5.Considering the nature of offence and also considering the period of incarceration, this Court is inclined to grant bail to the petitioner with certain 2/5
conditions.
6.Accordingly, this Criminal Original Petition is ordered and the petitioner is ordered to be released on bail on the following conditions:- i) The petitioner shall execute a bond for a sum of Rs.25,000/-(Rupees Twenty Five Thousand), with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate, Singampunari, Sivagangai District.
ii)The petitioner and the sureties shall submit a copy of their Aadhaar Card or any other identity card issued by the government in proof of their residence address;
iii)The petitioner shall report before the respondent Police once in a week, ie., on every Monday at 10.30 a.m. until further orders. He has to co-operate for the investigation.
iv)The petitioner shall pay a sum of Rs.15,000/-(Rupees Fifteen Thousand only) to the Panchayat Union Middle School, T.Valayangulam, Kallikudi (Taluk), Madurai District. v)The petitioner shall not misuse the liberty granted to them by indulging in any further offence and shall not tamper with the prosecution witnesses. They shall be available for the trial as well. 3/5
vi)On violation of any of the above conditions by the petitioners, the respondent police shall move an application for cancellation of the bail.
