RESPONDENTS IN HCP(MD).1914/2022 Petition filed praying that in the circumstances stated therein and in the petition filed therewith the High Court may be pleased to grant Interim Bail to the Petitioner's Son namely Arunpandi S/o.Selvam Age 28 years who is now detained in Central Prison Madurai for the period from 29.05.2023 to 03.06.2023. Prayer in Habeas Corpus Petition(MD) No. . 1914/ 2022 : Petition praying that in the circumstances stated therein and in the affidavit filed therewith, the High Court will be pleased to issue Writ or order direction in the nature of Writ of Habeas Corpus calling for the records in pursuant to the proceedings of the 2nd 1/3
Respondent in Detention order in No.77/2022 dt 15.8.2022 quash the same and consequently direct the respondents to produce the detenue, namely Arunpandi S/o.Selvam age 28 years who is now detained in Central Prison, Madurai before this Hon'ble Court and set him at liberty.
Order : This petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of M/S.SATHISH KUMAR.K, Advocate for the petitioner and of Mr.T.SENTHIL KUMAR, Additional Public Prosecutor on behalf of the Respondents, the court made the following order:- [Order of the Court was made by M.S.RAMESH, J] Citing the reason that the petitioner's son, who is the detenu, intends to attend his sister's marriage, which is scheduled to be held on 01.06.2023 in Divyashree Marriage Hall at NGO Colony, Dindigul, the petitioner seeks for interim bail for her son, who is detained under Act 14 of 1982, for the period between 29.05.2023 and 03.06.2023.
2.The learned Additional Public Prosecutor, on instructions, submitted that they have no objection if the detenu is granted interim bail for four days commencing from 31.05.2023 to 04.06.2023. 3.Recording the said submission of the learned Additional Public Prosecutor, interim bail is granted to the detenu, namely, Arunpandi, S/o.Selvam, aged 28 years, for the period between 31.05.2023 and 04.06.2023 together with escort, who shall be in plain clothes, at the cost of the petitioner, with the following condition:
the detenu shall execute a bond for a sum of Rs.25,000/- (Rupees twenty five thousand only) each with two sureties each for a like sum to the satisfaction of the Superintendent of Police, Madurai.
