[Order of the Court was made by P.T.Asha, J.] This writ petition has been filed seeking a Certiorarified Mandamus to quash the order passed by the respondent in his proceedings in e.f.vz;. 06/Nj.fy;Yg;gl;b fhty;-tl;lk;/2023> dated 21.05.2023, quash the same and direct the respondent to give permission to the village committee to conduct the cultural festival of Arulmighu Kaliyamman Temple Festival which is to be held on 30.05.2023, 31.05.2023 and 01.06.2023.

2. Heard the learned counsel on either side.

A reading of the impugned order would show that the permission has been denied, since in the earlier occasion on 18.07.2021, similar cultural program had led to a law and order situation and criminal proceedings were initiated against the organisers under Sections 147, 148, 294(b), 324, 323, 506(ii) IPC.

Further, on 14.01.2023, violating the permission granted by the respondent, Kabbadi competition had been conducted where once again there was a law and order situation in the very same village. Therefore, if permission is granted to conduct the cultural event, once again it would give rise to law and order situation.

Taking into account the reasons set out in the impugned order and also taking into consideration the fact that there appears to be some rivalry amongst two groups, the apprehension of the respondent appears to be bona fide and the rejection of permission cannot be faulted with.
