PRAYER: Criminal Original Petition is filed under Section 528 of BNSS Act, to direct the respondent to file a final report in Crime No.217 of 2024 forthwith before the Judicial Magistrate, Oddanchatram, and upon such filing of final report, direct the Judicial Magistrate, Oddanchatram to take cognizance and commit the case in crime No.217 of 2024 to the file of the Additional District Court, Palani for trial and further direct the Additional District Court, Palani, to conduct a simultaneous trial of the above case in crime No.217 of 2024 and S.C.No.26 of 2024 pending committal of the case in crime No.217 of 2024 direct the Additional District Court, Palani, to keep all further proceedings in S.C.No.26 of 2024 in abeyance.

ORDER

The present petition has been filed by the wife of the defacto complainant in crime No.217 of 2024 on file of the respondent police seeking a direction for expeditious filing of the final report. A consequential prayer has also been sought for as against the concerned Judicial Magistrate to take cognizance and commit the same to the file of the Additional District Court, Palani, for trial to be tried along with S.C.No.26 of 2024.

2. The learned Counsel for State of TN(crl.side) appearing for the respondent submitted that the charge sheet has been laid before the learned Judicial Magistrate, Ottanchathiram, through e-filing on 31.05.2026 and it is yet to be taken on file.

3. In view of the above said facts, it is open to the petitioner to approach the Judicial Magistrate, Ottanchathiram, for any further orders. 2/4

4. The committal proceedings, if any, shall be completed within a period of four weeks.

5. With the above said observations, this Criminal Original Petition stands disposed of. Consequently, connected miscellaneous petition is also closed.
