ORDER

The petitioner is before this Court seeking a direction to the respondent-TANGEDCO to transfer the electricity service connection bearing S.C. No.050210021189, provided to the premises situated at T.S. No.1625, Door Nos.13 and 13A, Hotel Taj Complex, T.P.K. Road, Madurai, to the name of the petitioner, without insisting upon a No Objection Certificate (NOC) from the other family members and coowners.

2. The petitioner claims that he is running a hotel in the said premises pursuant to a licence granted by the competent authority. The property originally stood in the name of the petitioner's deceased father, and consequently, the electricity service connection was also standing in 2/6

his name. Following the demise of his father, the petitioner submitted a representation seeking transfer of the service connection to his name.

The said request has not been acceded to by the respondents on the ground that the third respondent, who is the daughter of the deceased, is also claiming a share in the property and also asserts that the hotel run by the petitioner is a family business . It is stated that a suit in O.S. No. 333 of 2024 is pending on the file of the District Court, Madurai, seeking partition and separate possession of the property.

4. Admittedly, the petitioner is running a hotel in the subject premises, in respect of which the third respondent also claims to be a partner. No prejudice would be caused to the third respondent if the service connection is transferred to the name of the petitioner, particularly when the rights of the parties in relation to the property are already the subject matter of adjudication in the pending civil suit. 3/6

Accordingly, this Writ Petition is disposed of with a direction to respondents 1 and 2 to transfer the electricity service connection in question to the name of the petitioner, without insisting upon an NOC from the other co-owners. The said exercise shall be completed within a period of one week from the date of receipt of a copy of this order. No costs.

6. It is made clear that the petitioner shall not claim any equity or special right in the pending civil suit merely on account of the transfer of the service connection to his name. The Trial Court shall decide the issues arising in the suit independently, on the basis of the materials available on record, and shall not be influenced by the transfer of the service connection in favour of the petitioner. 03-06-2026 Index :Yes / No NCC :Yes / No PJL 4/6
