ORDER : The Court made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the offence punishable under Section 379 IPC r/w Section 21(4) of the Mines and Minerals (Development & Regulation)Act, in crime No.296 of 2021 on the file of the respondent police, seeks anticipatory bail.

2.The case of the prosecution is that the petitioner and other accused had illegally transported one unit of river sand without valid permit. Therefore, the present case came to be registered. 3.The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has nothing to do with the alleged occurrence.

CRL OP(MD)No.11012 of 2021 4.The learned Government Advocate(Crl.side) appearing for the respondent police submitted that the petitioner and other accused had illegally transported one unit of river sand. He further submitted that there is one case pending against the petitioner, which is similar in nature.

5.Considering the nature of allegations levelled against the petitioner and also the fact that one similar case is pending against the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, this criminal original petition is dismissed.
