ORDER

The petitioner challenges the show cause notice issued to him under Section 77A of the Registration Act wherein a complaint has been made for cancellation of the settlement deed registered as Document No.2483/2014.

2. The ground raised by the petitioner is that the third respondent herein had earlier made a complaint on 28.03.2022. Even before the complaint was closed, he made another complaint on 30.03.2023 and therefore, the present proceedings are not maintainable.

3. I am not in agreement with such submission. The gist of both the complaints are one and the same wherein Document No.2483/2014 is sought to be cancelled. The ground raised by the petitioner will not fall under any of the exceptions to which a writ petition challenging a show cause notice could be maintained. It is needless to point out that the petitioner is at liberty to substantiate his case before the second respondent in the proceedings pending. 2/4

4. With the above observations, the writ petition stands dismissed. No Costs.
