ORDER

This Criminal Original Petition has been filed directing the second respondent not to harass the petitioner under the guise of inquiry in respect of complaint dated 22.06.2022 given by the petitioner.

2. The facts of the case are that the petitioner being a pastor, was instructed by IELC for maintaining the Church in Kodaikanal and District District, since 1983. While being so, a dispute was arose between the petitioner and the private respondents with regard to the encroachment of the Church at Kodaikanal. The private respondents illegally demolished the portion of the Church. In this regard, the petitioner preferred a complaint dated 22.06.2022 against the private respondents, but no action was taken. In pursuance of the complaint, the respondent Police frequently called the petitioner for enquiry, thereby, harassing the petitioner under the guise of enquiry. Hence, the present Criminal Original Petition has been filed. 2/4

The learned Government Advocate (Criminal Side) appearing for the respondent Police submitted that a case has been registered in Crime No.130 of 2022 for offences under Sections 294(b), 323, 324, 506(i) I.P.C. After the registration of the case, there is no complaint pending. The petitioner is the third accused in this case and the case is now under investigation.
