PRAYER :- Petition filed under Sec.483(3) of BNSS to cancel the anticipatory bail granted to the respondents 1 to 3 in Crl.O.P(MD) NO.4904 of 2026 dated 06.03.2026 on the file of this Court in Crime No.6 of 2026 on the file of the fourth respondent and re-numbered as Crime No.12 of 2026 on the file of the Inspector of Police, All Women Police Station, Samayanallur, Madurai District ORDER : The Court made the following order :- This Petition has been filed to cancel the anticipatory bail granted to the respondents 1 to 3 in Crl.O.P(MD) NO.4904 of 2026 dated 06.03.2026 on the file of this Court in Crime No.6 of 2026 on the file of the fourth respondent and re-numbered as Crime No.12 of 2026 on the file of the Inspector of Police, All Women Police Station, Samayanallur, Madurai District

2. The learned counsel appearing for the petitioner would submit that the petitioner is the defacto complainant in this case. Based on the complaint lodged by the petitioner a case has been registered in Crime No. 6 of 2026 for the offences under Sections 498(A), 109 of IPC. Infact the respondents 2 and 3 are the in-laws of the petitioner and the first respondent is the husband of the petitioner and thereby the case has been registered. Initially zero FIR has been registered by the All Women Police Station, 2/6

Thilagarthidal, Madurai and thereafter the same was transferred to All Women Police Station, Samayanallur, Madurai District and thereafter fresh First Information Report has been registered in Crime No. 12 of 2026 and thereafter the respondents 1 to 3 have approached this Court for grant of anticipatory bail by suppressing the material facts that IDOP No.1418 of 2023 was pending before the Family Court, Madurai and thereafter the same was withdrawn and fresh petition in IDOP NO.68 of 2025 was filed by the petitioner before the I Additional District and Sessions Court, Madurai, On that date the respondents 1 to 3 have misrepresented before this Court about withdrawal of the case in IDOP No.1418 of 2023.

Infact the said case has been pending for appearance of parties and therefore the anticipatory bail granted to the respondents 1 to 3 has to be cancelled. 3.The learned counsel appearing for the respondents 1 to 3 would submit that there is a family dispute between the parties. The defacto complainant is none other than the wife of the first respondent and in-laws of the respondents 2 and 3. While so, there is a matrimonial dispute between the defacto complainant and the first respondent and due to family dispute a false case has been lodged by the petitioner.

and after considering the facts and circumstances of the case and the pendency of the matrimonial dispute granted anticipatory bail and there is no suppression of facts as alleged by the petitioner and thereby the present petition is liable to be dismissed.

4. Heard both sides and perused the materials available on record.

On perusal of records, it is seen that based on the complaint lodged by the petitioner a case has been registered in Crime No. 6 of 2026 for the offences under Sections 498(A), 109 of IPC and thereafter they approached this Court for grant of anticipatory bail in Crl.O.P(MD) No.4904 of 2026 and this Court also granted anticipatory bail. Further at the time of considering anticipatory bail considering the facts and circumstances of the case and the fact that the petitioner has stated about the filing of IDOP No. 1418 of 2023 and the same was withdrawn on 24.10.2025 and thereafter IDOP No.68 of 2025 was filed before the I Additional District Court, Madurai and the same is pending for which the respondents have not produced any proceedings and this Court has not granted anticipatory bail only on the basis of filing of IDOP and this Court granted anticipatory bail considering the relationship between the parties and facts and 4/6

circumstances of the case and thereby granted anticipatory bail on merits and there are no grounds to cancel the anticipatory bail granted by this Court and thereby the petition has no merits and deserves to be dismissed. 6.Accordingly the Criminal Original Petition stands dismissed.
