PRAYER : FOR ANTICIPATORY BAIL IN CRIME NO.510 OF 2021 ON THE FILE OF THE RESPONDENT POLICE.
ORDER : The Court Made the following order :- The petitioner/Accused No.6, apprehending arrest at the hands of the respondent police for the alleged offence punishable under Sections 147, 294(b), 324 and 302 of IPC, in Crime No.510 of 2021 on the file of the respondent police, seeks anticipatory bail. 2.The case of the prosecution is that on 07.08.2021, at about 03.45 p.m, the defacto complainant went to get money from her husband namely, Raja, who is working as Assistant in the Sakkara Cable T.V Firm situated near Moorthy Studio, Melur Town. At that time, one Ragunath came there and parked his Car by obstructing the pathway to the cable office. This was questioned by the husband of the defacto complainant. Due to which, wordy quarrel arose between them. As a result of which, one of the co-accused called other persons and they came to the place of occurrence and caused assault with iron rod. He was taken to the Government Hospital, Melur and declared died. Hence, the complaint.
3.The learned counsel for the petitioner submitted that the petitioner is innocent and he has been falsely implicated in this case. He further submitted that co-accused was arrested and released on bail. Even as per the averments of FIR, there was no motive between them. Due to sudden quarrel, the said occurrence was took place 1 year back.

CRL OP(MD) No.11663 of 2022 4.It is seen that it is a case of anticipatory bail. No specific ground has been made out by the petitioner for excising discretionary relief of anticipatory bail. In view of the occurrence said to have taken place and reason for the occurrence, the petitioner is not entitled for discretionary relief of anticipatory bail. Hence, the petitioner may surrender before the concerned respondent police or surrender before the concerned Court. 5.Accordingly, this Criminal Original Petition is dismissed with the above said liberty and direction.
