O R D E R

The Writ Petition is filed seeking a direction to the respondents to deposit the sum of Rs.56,868/-(Rupees six thousand eight hundred and sixty eight only) mentioned in Award No.2 of 2023, dated 30.6.2023 along with interest before the Honourable Principal District Court,Pudukkottai. 2.Mr.M.Gangadharan, learned Government Advocate takes notice for the respondents 1 to 3. By consent of both parties, the Writ Petition is taken up for final disposal at the admission stage itself.

3.It is not in dispute that the land belongs to the Petitioner comprised in S.NO.309/18B to an extent of 0.02.70 ares was acquired by the respondents for construction of Cauvery-VaigaiGundar Link Canal Project. Already the competent authority passed an order fixing the compensation payable to the Petitioner at Rs.56,868/-.

4.The respondents so far failed to pay the compensation amount as fixed in Award No.2 of 2023. Therefore the Petitioner has come before this Court with the present Writ Petition for the relief stated supra.

5.The learned Government Advocate, who takes notice for the respondents 1 to 3 would submit that during enquiry, it was found that there was encumbrance in the property in the nature of attachment passed by the Civil Court in O.S.No.1969 of 1989, on the file of District Munsif Court, Pudukkottai. Therefore there is difficulty in making payment to the Petitioner directly. However, the second respondent is willing to deposit the award amount of Rs.56,868/- before the Principal District Judge, Pudukkottai within a period of 12 weeks.

6.In view of the submission made by the learned Government Advocate appearing for the respondents 1 to 3 that the award amount will be deposited before the competent Court within a period of 12 weeks to enable the Petitioner to work out his remedy, recording the above said statement made by the learned Government Advocate, the Writ Petition stands disposed of. No costs.
