For Respondent : Mr.B.Thanga Aravindh, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.104/2023 on the file of the respondent police.

ORDER : The Court made the following order :- The petitioner/A2, who apprehends arrest at the hands of the respondent Police for the offences punishable under Sections 147, 148, 294(b), 323, 324, 506(ii) and 379 of IPC in Crime No.104 of 2023 on the file of the respondent Police, seeks anticipatory bail. 2.The case of the prosecution as per the de-facto complainant, is that the petitioner along with other accused abused the defacto complainant, assaulted and also had taken away 1 3⁄4 sovereigns of gold and one sovereign of gold ring. Hence, the complaint. 3.Heard both side and perused the materials available on record including the First Information Report.

4.It is seen that there are totally six accused in this case and the petitioner herein is arrayed as A2. Under the influence of alcohol the petitioner herein along with other accused assaulted the defacto complainant and had taken away 1 3⁄4 sovereigns of gold and one sovereign of gold ring. CRL OP(MD). No.9491 of 2023 remanded to judicial custody no recovery has been made from them. Therefore custodial interrogation of the petitioner is very much required in this case, hence this court is not inclined to grant anticipatory bail to the petitioner.
