PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus, directing the third respondent to take appropriate action on the representation of the petitioner dated 17.05.2023 as expeditiously as possible within the time frame by this Court. O R D E R

This petition is filed under Article 226 of the Constitution of India seeking for a direction to the respondent Police to dispose of the representation of the petitioner dated 17.05.2023.

2. It is submitted by learned counsel for the petitioner that the petitioner has filed a complaint against the unofficial respondents and others in respect of the misappropriation of temple funds. The respondent Police are not taking any action. Hence, sought for suitable directions.

3. On the other hand, learned Government Advocate (Criminal Side) submits that the petitioner himself is not cooperating with the investigation and not appearing before the respondent Police and submitted further that basing on the representation of the petitioner, dated 17.05.2023, notices were given to both the parties and unofficial respondents have submitted the accounts to the Tahsildar and subsequently, stalemate occurred and issue has not been resolved, thereby the petitioner's representation dated 17.05.2023 is still pending.

4. According to the petitioner, the unofficial respondents have committed the misappropriation of funds. Therefore, the respondent Police are 2/4

directed to complete the enquiry in respect of the representation dated 17.05.2023 and take appropriate action. The respondent Police are further directed to complete the enquiry and dispose of the representation dated 17.05.2023 as quickly as possible not later than two weeks from the date of receipt of a copy of this order and the petitioner is directed to appear before the respondent Police and cooperate with the enquiry on receipt of the summons.

5. With the above observation, this Writ Petition stands disposed of. No costs.
