for M/s.S.PRABHA, Advocate For Respondent : Mr.R.SURESH KUMAR, Government Advocate (Crl.Side) PRAYER :- To Modify the condition imposed by Principal Sessions Judge, Thoothukudi in Cr.M.P.No.2683 of 2023 dated 28.04.2023 and modify the condition from depositing sum Rs.20,000. ORDER : The Court made the following order :- This petition has been filed to modify the conditions imposed on the petitioner in Cr.M.P.No.2683 of 2023 dated 28.04.2023 by the learned Principal Sessions Judge, Thoothukudi. 2.The learned counsel for the petitioner submitted that the petitioner and his family members are doing collie workers and therefore, the petitioner is not in a position to deposit a sum of Rs.20,000/- before the learned Judicial Magistrate, Sathankulam. Since the petitioner could not comply with the said condition, he is still in custody and he could not enjoy the fruits of the bail order. Hence, the petitioner seeks modification of the said condition.
3.The learned Government Advocate (Crl.Side) opposes grant of relief.
4.Considering the facts and circumstances of the case, the second condition imposed by the learned Principal Sessions Court, https://www.mhc.tn.gov.in/judis 1/2
CRL OP(MD). No.9532 of 2023 Thoothukudi in Cr.M.P.No.2683 of 2023 dated 28.04.2023 stands relaxed. The other conditions imposed on the petitioner shall remain unaltered.
