PRAYER: Civil Revision Petition is filed under Article 227 of Constitution of India, to call for the records and set aside the docket order dated 01.04.2025, passed in I.A.No.01 of 2025 in O.S.No.104 of 2025, on the file of Additional District Munsif Court, Kumbakonam, thereby grant Ad Interim Injunction. ORDER

The plaintiff in O.S.No.104 of 2025, on the file of the Additional District Court, Kumbakonam, has filed the present revision petition challenging an order of notice in I.A.No.1 of 2025, instead of granting interim injunction. 1/3

2.According to the learned Counsel appearing for the revision petitioner, taking advantage of the order of notice issued by the trial Court, the defendant in the suit is attempting to demolish his house located in T.S.No.2241, which is not a water body.

3.The defendant in the suit has been issued notice for removal of encroachment made by the revision petitioner herein for T.S.No.2242. Pending disposal of I.A.No.1 of 2025, the authorities shall not disturb the possession of the petitioner in T.S.No.2241.

4.It is made clear that the trial Court has to dispose of the Injunction Application as expeditious as possible at least before 30.06.2025. 5.With the above said observations, this Civil Revision Petition stands disposed of. No costs. Consequently, connected miscellaneous petition is also closed.
