For Respondent : Mr.T.Senthilkumar, Additional Public Prosecutor PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.224 of 2022 on the file of the Respondent Police.

ORDER : The Court made the following order :- The petitioner/A6, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 8(c) r/w 20(b)(ii)(C) and 25 of the Narcotic Drugs and Psychotropic Substance Act, 1985, in Crime No.224 of 2022 on the file of the respondent police, seeks anticipatory bail.

2.The case of the prosecution is that the petitioner along with other accused were found in illegal possession of 34kgs of Ganja. Hence, the case.

3.Heard. Perused the materials available on record including the First Information Report.

4.It is seen that there are totally 10 accused in this case and the petitioner is arrayed as A6. That apart, he also involved in another case, which was registered in Crime No.161 of 2018 on the https://www.mhc.tn.gov.in/judis

file of the Andipatti Police Station, for similar offence. That apart, the petitioner had already filed a petition for anticipatory bail and the same was dismissed by this Court in Crl.O.P.(MD) No.15454 of 2022 on 03.11.2022. In the said fact has been now suppressed by the petitioner and filed this petition as if it is a first application for anticipatory bail. Therefore, this Court is not inclined to grant anticipatory bail to the petitioner. 5.In view of the same, this criminal original petition stands dismissed with costs. The petitioner is directed to pay a sum of Rs.5,000/- (Rupees Five thousand only) as costs to the legal services authority attached to this Bench.
