Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, to direct the first respondent to issue passport to the petitioner by considering the petitioner's application file No. MD 1067547789525 and to permit the petitioner to go to abroad within the time limit that may be stipulated by this Court. ORDER

This writ petition has been filed for writ of Mandamus, directing the the first respondent to issue passport to the petitioner by considering the petitioner's application and to permit the petitioner to go to abroad within the time limit stipulated by this Court.

2. It is submitted that FIRs have been registered against the petitioner in Crime Nos.30 of 2022 and 346 of 2022 before the second respondent police station for the offences under Section 147, 148, 447, 294 (b), 323, 506 (1) and 379 IPC and 143, 147, 427 of IPC and 3(1)(g) of SC/ST (Prevention of Atrocities) Act, 1989.

3. The learned Government Advocate for the second respondent submits that charge sheet has been framed against the petitioner in the first case and the said case is presently pending in C.C.No.5 of 2023. The petitioner has been arrayed as Accused No.4 and 6 in the respective cases. He further submits that the second case has been transferred to the Sub Court for SC/ST cases, Sivagangai and it is yet to be numbered. 2/4

Considering the fact that a charge sheet has been filed against the petitioner in the first case and the trial has already commenced, the question of granting any relief to the petitioner by this Court does not arise. It is however open for the petitioner to move the competent Court for appropriate relief in accordance with the provisions of Passports Act, 1967.
