PRAYER :- For Bail in Crime No.14 of 2022 on the file of the Respondent Police.
ORDER : The Court made the following order :- The petitioner/Accused No.3, who was arrested on 10.06.2022 for the alleged offence under Sections 419, 420, 468, 471 r/w 34 of IPC, in Crime No.14 of 2022, on the file of the respondent police, seeks bail.
2.The case of the prosecution is that originally, the property belong to the defacto complainant. The first accused had impersonated the defacto complainant and executed a Power deed infavour of the petitioner. Based on that, the petitioner had executed sale deeds to several persons. Hence, the petitioner and other co-accused were arrested and remanded to judicial custody on 10.06.2022. Ever since he is in custody.
3.The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution.
4.The learned Government Advocate (Crl.Side) submitted that the petitioner is facing two previous cases in similar nature and the other co-accused are absconding.
5.It is the contentions on the part of the learned counsel for the petitioner is that the petitioner is doing Real Estate business. The defacto complainant, who is the owner of the property, executed https://hcservices.ecourts.gov.in/hcservices/ 1/2

6.Even though, contention raised by the learned counsel for the petitioner cannot be accepted at this stage. Perusal of CD file shows that investigation is not yet commenced. 7.But, however, considering the period of incarceration, this Court is inclined to grant bail to the petitioner with stringent conditions.
8.Accordingly, this Criminal Original Petition is allowed and the petitioner is ordered to be released on bail, on executing a personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the Land Grabbing Court Cum Additional Mahila Court, Trichy, and on further condition that the petitioner shall report before the respondent police daily at 10.30 a.m. until further orders. 9.The petitioner is directed to appear before the respondent police and co-operate with him to complete the investigation. sd/- 30/06/2022 / TRUE COPY / 30/06/2022 Sub-Assistant Registrar (C.S.)
