ORDER : The Court made the following order :- The learned Senior Counsel appearing for the petitioner seeks permission of this Court to withdraw the petition. 2.At this juncture, the learned Senior Counsel appearing for the petitioner submitted that the petitioner and his wife, on the date of occurrence, i.e., 23.07.2020, in the Poorvika Mobile Shop, situated at Trichy and to prove the same, he has also produced CCTV Footage and photographs taken from the CCTV Footage before this Court.

3.On the other hand, the learned Government Advocate (Criminal Side) appearing for the respondent police produced the dying declaration of the victim.

4.It reveals that the presence of the petitioner and his wife are very much availabe and as such, the CCTV footage and photographs produced by the learned Senior Counsel cannot be appreciated by this Court in the anticipatory bail.

CRL OP(MD). No.11347 of 2020 5.This Criminal Original Petition is dismissed as withdrawn. However on surrender of the petitioner herein, the respondent police is directed to investigate the submission of the learned Senior Counsel in respect of the petitioner and his wife's presence at the time of occurrence at Poorvika Mobile shop, Trichy. sd/- 05/11/2020 / TRUE COPY / / /2020 Sub-Assistant Registrar (C.S.)
