Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus, to direct the Respondents to allot housing patta to the members of the Scheduled Castes Community and other weaker section of the society, residing in Kayampatti Medu, Kayampatti, Chittampatti and Viswanathapuram colony, Madurai District, for their dwelling houses in the land in Madurai East Taluk-83, Thamarai patti I pit village survey No.44/1B2 and 44/2A by considering the representations submitted by the petitioner dated 19.06.2017 and 17.07.2017 in accordance with law within the time stipulated by this Court. [Order of the Court was made by K.K.SASIDHARAN, J.] The petitioner filed this Writ Petition to direct the respondents to allot housing patta to the members of the Scheduled Castes Community and other weaker sections of the society, who are residing in and around Kayampatti Medu, Kayampatti, Chittampatti and Viswanathapuram Colony, Madurai District.
2. According to the petitioner, there is a vast land at Thamaraipatti I pit village in Survey Nos.44/1B2 and 44/2A. The petitioner, therefore, wanted the Government to allot the land to the members of the downtrodden community, taking into account their eligibility.
3. Mr.M.Govindan, learned Special Government Pleader, on the basis of the written instructions given by the Deputy Tahsildar, Madurai East Taluk, submitted that there is a proposal to allot a portion of the land at Thamaraipatti I pit village to the Journalists for their housing purpose.
4. The petitioner has come up with this Writ Petition for a direction to the respondents to allot 191 house sites to 191 families, who are residing in and around Kayampatti Medu, Kayampatti, Chittampatti and Viswanathapuram Colony, Madurai District. There is no question of issuing a direction to the respondents for allotment of land on the basis of the representation given by the petitioner. In case any of the persons named in the representation are in need of land and they are eligible for such allotment, it is always open to them to approach the District Collector, Madurai.
5. We, therefore, give liberty to the individual applicants to approach the District Collector, Madurai, with appropriate representation for allotment of land. In case any such representation is given by the individual applicants, the same shall be considered and disposed of by the District Collector, taking into account their eligibility and the availability of the land.
6. The Writ Petition is disposed of, with the above direction. No costs.
