Respondents PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, praying for issuance of a writ of mandamus, directing the respondent No.1 and 2 to survey the petitioner's property and fix boundary stones in connection with properties in survey Nos.196/4, to an extent of 8 cents,

196/3A to an extent of 4 cents, and 196/5B, to an extent of 1 acre 15 cents, measuring 1 acre, situated at Kumaravadi Village, Manapprai Taluk, Trichy District, under the supervision of the 3rd respondent for surveying the land by considering the representation of the petitioner, dated 21.04.2025. For Petitioner :

ORDER

The petitioner herein seeks a direction to respondents 1 and 2 to survey the petitioner's property and fix boundary stones in respect of the land situate in survey Nos.196/4, 196/3A, and 196/5B, at Kumaravadi Village, Manapprai Taluk, Trichy District,

2. According to the petitioner, the above mentioned property was settled in her favour by her father under settlement deeds, dated 10.12.1985 and 08.11.1990. The petitioner submitted a representation before the respondents 1 and 2, seeking survey of the lands and the same has been objected to by the respondents 4 and 5. In these circumstances, the petitioner has approached this Court, seeking a direction to the respondents 1 and 2 to survey her lands, mentioned above.

3. Mr.A.Baskaran, Additional Government Pleader, takes notice for respondents 1 and 2, and Mr.M.Vaikam Karunanithi, Government Advocate, for respondent No.3.

4. Learned Additional Government Pleader for respondents 1 and 2 would submit that in view of the objection raised by the respondents 4 and 5, the first respondent could not complete the survey, as requested by the petitioner.

5. In view of the above, without going into the merits of the claim made by the petitioner, this Court is inclined to direct the first respondent to consider the representation of the petitioner, dated 21.04.2025, on its own merits and pass final orders within a period of twelve weeks from the date of receipt of copy of this order, after issuing notice to the petitioner and the respondents 4 and 5.

6. Writ Petition is disposed of accordingly. No costs. 02.06.2025 NCC :
