Writ Petition is filed under Article 226 of the Constitution of India, praying for issuance of a Writ of Mandamus, directing the third respondent to receive the necessary application fee for new electricity service connection from the petitioner and consequently direct the third respondent to give new electricity service connection for the petitioner's shop Nos.8/901/1A, 8/901/1B, 8/901/1C, 8/901/1D, 8/901/1E, 8/901/1G and 8/901/1H in S.No.75/2A1 Punja Land for an extent of Hector 0.18.0, Cents 44 at Virudhunagar Village, Kalaingar Nagar, Virudhunagar District based on the petitioner's representation dated 26.07.2017. The petitioner seeks for issuance of a Writ of Mandamus directing the third respondent to receive the necessary application fee for new Electricity Service Connection from the petitioner and consequently directing the third respondent to give Electricity Service Connection to the petitioner's shops. 2.It is stated that the petitioner has purchased a vacant land at Virudhunagar Village, Virudhunagar District in S.No.75/2A1 Punja Land for an extent of Hector 0.18.0, Cents 44 from K.Sangaralingam for a valid consideration sum of Rs.75,690/-. deed was registered as Document No.392/2017 and patta has also been issued in Patta No.1201 and 10(1) Adangal and 'A' Register also carries the name of the petitioner on 03.04.2017. 3.It is further stated that the petitioner had obtaining building plan approval from the Special Officer, Paavaali Village Panchayat, Virudhunagar in B.P.No.12/2017-2018. In addition, the petitioner has also got Electricity Service Connection in E.B.No.228-05/17-314 on 22.05.2017 for only one shop No.8/901/1F. Subsequently, when the petitioner approached the third respondent for Electricity Service Connection for the other seven shops, he had refused to receive the application. Therefore, the petitioner has come before this Court with the present writ petition. 4.
The learned counsel appearing for the respondent / Electricity Department submitted that the application filed by the petitioner would be duly considered on merits and Electricity Service Connection would be given to the petitioner's shops, if the petitioner complies with all the procedures as per law. 5.Recording the said submission, the third respondent is hereby directed to process the application and do the needful as expeditiously as possible, preferably within a period of six weeks from the date of receipt of a copy of this order. 6.The Writ Petition stands allowed with the above direction. No costs.
