ORDER

This writ petition is filed for a mandamus directing the first respondent to frame a scheme for Manbussalah Arabic College in Thoothukudi, Jamia Mosque campus at W.G.C Road, Thoothukudi, as per the proposed by-law dated 15.01.2015.

2.It is the contention of the petitioner that the proposed by-law which contains the scheme of governance in respect of the said college was proposed, but however the final scheme is said to be framed by the Waqf Board.

3.The learned counsel would submit that the administration of the college itself is being put to jeopardy, unless the proposed by-law is finalized and approved by the Government and thereafter elections are conducted, as per the by-law the administration takes a back seat.

4.When the matter came up for hearing, the learned counsel taking notice on behalf the waqf board would submit that if four months time is granted, appropriate orders will be passed framing the scheme. 5.In view thereof, this writ petition is disposed of on the following terms:

(i)The first respondent is directed to take up the said issue of framing of scheme as per the proposed by-law dated 15.01.2025 after following due process of law. It shall frame a scheme in the manner known to law, by affording an opportunity to everyone concerned, within a period of four months from the date of receipt of the web copy of the order. (ii)No costs.
