PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the respondent 4 and 5 to initiate appropriate legal action against the respondents No.6 and 7 based on the petitioner's complaint and representation dated 22.04.2025 within a stipulated time. The petitioner with a grievance that his complaint, dated 22.04.2025 with regard to missing of his vehicle bearing Engine No.E3654208, Chase Number - TO535818404L has not been enquired by the respondent police, has submitted a representation and filed this writ petition, seeking a direction to the respondents 4 and 5, to take legal action as against the respondents 6 & 7, by considering his representation.

2.Mr.F.Deepak, learned Special Government Pleader takes notice for the respondents 1 to 3 and Mr.A.S.Abul Kalaam Azad, learned Government Advocate (Crl.side) takes notice for the respondents 4 & 5.

3.The learned Government Advocate (Crl.side) based on the written instructions provided to him submits that the aforesaid vehicle bearing Engine No.E3654208, Chase Number - TO535818404L was purchased by the petitioner, by availing loan 3/6

from INDUSIND Bank and he has failed to repay the loan amount, as per the hire purchase terms. Therefore, an enquiry was conducted and during the enquiry, the vehicle was recovered and sold through auction.

4.Recording the submission made by the learned Government Advocate (Crl.side), this writ petition is closed with liberty to the petitioner to work out his remedy as against the INDUSIND Bank, if he is having any ground. No costs. 03.06.2025 NCC: Yes/No Index:Yes/No Internet:Yes vrn 4/6
