Writ Petition is filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus, directing the respondents to consider the petitioner's representation dated 01.07.2017, thereby directing forthwith to return his licensed Double Barrel Bridge Load Gun (bearing No.1609402) and 4 Air Guns within the time stipulated by this Honble Court.

ORDER

This writ petition has been filed by the petitioner, seeking a writ of Mandamus to direct the respondents to return his Double Barrel Bridge Load Gun, by considering his representation dated 01.07.2017.

2.Heard the learned Counsel on either side.

3.The case of the petitioner is that his licensed Double Barrel Bridge Load Gun (Bearing No.1609402) and 4 Air Guns were seized by the respondents on 05.05.2015 and though enough explanations were given by the petitioner, the same were not returned to him. A representation dated 01.07.2017, was also submitted before the respondents in this regard. According to the petitioner, the same has not been considered so far and hence, he is before this Court.

4.Per Contra, the learned Special Government Pleader submitted that based on the representation of the petitioner, an order dated 18.08.2017, came to be passed, directing the Deputy Superintendent of Police, Arms wing, to proceed as per law. 5.According to the learned Counsel for the petitioner, such an order has not been placed to the petitioner or not served on the petitioner, till date.

6.Such being the case, straight away, the learned Special Government Pleader is directed to furnish a copy of the same to the petitioner to proceed further. Accordingly, the learned Special Government Pleader produced a copy of the order dated 18.08.2017, to the learned Counsel appearing on behalf of the petitioner. 7.Hence, this writ petition is disposed of with liberty to the petitioner to proceed further.
