*********** [Order of the Court was made by G.R.SWAMINATHAN, J.] This writ petition has been filed in public interest. The petitioner challenges the impugned Bid Invitation dated 26.06.2017 issued by the second respondent. It is the specific contention of the writ petitioner that the impugned public tender floated by the second respondent is in respect of certain works for which already tenders have been awarded. In other words, the writ petitiner alleges duplication of work. For one work if the impugned tender is not set aside, there will be award of two contracts for a single work.
2.Finding prima facie merit in the contention of the writ petitioner, this court ordered notice and also granted interim injunction. After notice, the learned special Government pleader appearing for the respondents submitted before this Court that the preliminary enquiry has already been registered on 07.01.2006 against the petitioner B.Ravichandran, Superntending Engineer, PWD, WRD, Trichy. A copy of the registration in PE.288/2017/ PWD/TH, dated 08.08.2017 was also furnished before this court. A specific statment was also made that the first respondent shall enquire into the matter and ensure that there is no duplication of work. 3.Recording the submission, this Writ petition is disposed of. No costs. Consequently, connected miscellaneous petitions are closed.
