Prayer : Criminal Original Petition filed under Section 482 of the Code of Criminal Procedure, to direct the second respondent not to interfere in the free and fair enquiry, which is being conducted by the third respondent on the complaint given by the petitioner on 28.06.2021 and consequently to direct the first respondent to monitor the said enquiry of the third respondent on such complaint and to pass further orders.

ORDER

This petition is filed seeking a direction to the second respondent not to interfere into the complaint that has been given by the petitioner before the third respondent herein. 2.The case of the petitioner is that he is working as a teacher in a private school and she made a complaint against one Alex before the third respondent on 28.06.2021. The said Alex is also a teacher, in which the petitioner is working. The complaint is based on the refusal on the part of the said Alex to marry the https://hcservices.ecourts.gov.in/hcservices/ 1/2

Crl.O.P.(MD)No.11083 of 2021 petitioner. The grievance of the petitioner is that the second respondent is unnecessarily interfering with the enquiry undertaken by the third respondent. Hence, this petition. 3.The learned Additional Public Prosecutor would submit that there was a complaint and counter complaint given by the petitioner and one Alex and during the course of enquiry, it came to know that there is no basis in the complaint and on that ground, both the complaints were closed on 24.07.2021.

4. Let the closure report be circulated to the learned counsel for the petitioner. Recording the submission made by the learned Additional Public Prosecutor that enquiry was closed, nothing survives for further consideration or direction in this petition. Accordingly, this Criminal Original Petition is dismissed as infructuous, with liberty to the petitioner to work out her remedy if aggrieved by the closure reportS through appropriate proceedings.
