Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus and thereby direct the 1st respondent to receive the additional security deposit of Rs.20,47,005/- as per the order of the 1st respondent in Lr.No.SE/VIRUDUNAGAR 079094620181/ D.No.344/23 dated 18.05.2023 in 10 monthly equl installments. ORDER

This petition has been filed seeking a direction that the additional Security deposits sought by the respondents to a sum of Rs.20,47,005/- may be paid in 10 monthly equal installments by the petitioner herein.

The petitioner was served with a similar notice directing to furnish additional security deposit of a sum of Rs.55,33,994/- and seeking permission to pay the said amount in a monthly installments, he had filed W.P.(MD)No. 16345 of 2022 (M/s. Arun Spinning Mills Pvt. Limited., Vs Superintending Engineer, TANGEDCO, Virudhunagar and others). By an order dated 01.08.2022,a learned Single Judge of this Court had granted permission to the petitioner to pay the said Additional Security Deposit of Rs.55,33,994/- in six equal monthly installments.

3. Learned Standing Counsel for the respondent insisted that the same monthly installments may be adhered to even in the present case. It is seen that the petitioner was directed to pay nearly twice the amount as sought for now as six monthly installments in the earlier writ petition. The same direction is retained and the petitioner is permitted to pay the additional Security Deposit of Rs.20,47,005/- in six equal monthly installments. The first installment / payment should be done on or before 02.07.2023 and thereafter the petitioner should adhere to pay the balance in further five equal monthly installments.

4. This Writ petition stands disposed of. There shall be no order as to costs. Consequently, connected miscellaneous petitions are closed. 02.06.2023 NCC : Yes/No Index : Yes / No Internet : Yes/ No pnn 3/4
