Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the respondents 2 to 4 to provide adequate police protection to restore the fence which is decreed by this Court in S.A.No. 1757 of 1998 in favour of the petitioner further confirmed by the Apex Court in S.L.P. (C) No. 15563/2020 dated 17.05.2023 thereby consider the petitioner representation dated 25.03.2023, within the stipulated time frame fixed by this Court.

O R D E R

This Writ Petition has been filed seeking a direction to the respondents 2 to 4 to provide adequate police protection by considering the petitioner's representation dated 25.03.2023. 2/5

2.According to the petitioner, he sent the representation dated 25.03.2023 to the third respondent, but the same has not been considered. Hence this petition.

3.The learned Government Advocate (Crl.Side) appearing for the respondent police would submit that the petitioner's representation is under consideration with the third respondent and they will conduct enquiry and take appropriate action, in accordance with law. 4.Considering the limited scope of the prayer sought for in this petition, this Court, without even issuing notice to the private respondents, is inclined to pass order.

5.Recording the said submission that the petitioner's representation is pending with the third respondent, this Court directs the third respondent to conduct enquiry upon the petitioner's representation dated 25.03.2023 and take appropriate action, in accordance with law, within a period of fifteen days, from the date of this order, after affording opportunity to both the parties.
