For Respondent : Mr.T.Senthilkumar, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 of Cr.PC PRAYER :- For Anticipatory Bail in Crime No.372/2021 on the file of the Respondent Police ORDER : The Court made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the offence punishable under Section 379 of IPC and Sections 21(1) and 21(2) of the Mines and Minerals (Development Regulation) Act 1957 in Crime No.372 of 2021 on the file of the respondent police, seeks anticipatory bail. 2.The case of the prosecution is that the petitioner and other accused have illegally transported 1⁄4 unit of river sand by using bullock kart. Therefore, the present case came to be registered. 3.The learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has nothing to do with the alleged case of the prosecution.

4.The learned Government Advocate(Crl.side) appearing for the respondent police submitted that the petitioner had illegally transported 1⁄4 unit of river sand in bullock kart. He further https://hcservices.ecourts.gov.in/hcservices/ 1/2

CRL OP(MD)No.11092 of 2021 submitted that the petitioner has one similar previous case pending against him in Cr.No.587 of 2021.

5.Considering the nature of allegation levelled against the petitioner and also the fact that the petitioner has one similar previous case, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, this criminal original petition is dismissed.
