police for the offence under Sections 269, 270, 273, 328 of IPC and Section 24(1) of Cigarette and other Tobacco Products Act, 2003, in Crime No.229 of 2024, on the file of the respondent police seek anticipatory bail. 2.The case of the prosecution is that the petitioners were in possession of 126.45 kgs of banned tobacco products.
3.The learned counsel for the petitioners submits that the petitioners are innocents and they have not committed any offence as alleged by the prosecution. 4.The learned Government Advocate (Crl.side) appearing for the respondent objects for grant of anticipatory bail to the petitioners that the investigation in this case is yet to be completed. 5.Though the respondent police is said to have recovered 126.45 kgs of banned tobacco products, they have not secured the accused persons, which shows the influence of the petitioners. Therefore, this Court is of the opinion that granting anticipatory bail would certainly affect the prosecution case. 2/3
