ORDER

This criminal original petition has been filed seeking to quash the FIR in Crime No.2501 of 2016 on the file of the respondent No.1. 2.The petitioner is the accused in Crime No.2501 of 2016 on the file of the respondent police registered for the offence punishable under Sections 392 & 397 of IPC. Seeking quashment of the same on various grounds, this petition has been filed.

3.The learned Additional Public Prosecutor would submit that after completing the investigation, this petitioner was not shown as accused and only three persons were shown as accused and final report also filed before the learned Judicial Magistrate No.II, Padmanabhapuram. The same was also taken cognizance in C.C.No.174 of 2021.

4.But, the learned counsel for the petitioner would submit that while applying for passport, it was submitted that the present FIR is pending against him.

5.Since already the name of the petitioner was deleted from the FIR, nothing survives for further consideration in this petition. The matter become infructuous.

6.Accordingly, this criminal original petition stands disposed of as infructuous. Consequently, connected miscellaneous petition is closed. 14.06.2023 NCC :
