PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the respondents No. 1 to 3 to take action against the respondents 4 1/5

O R D E R

The petitioner has lodged a complaint before the respondent police on 27.04.2025 that one Ansar Ali and Jeenath Begum, the respondents 4 & 5 herein have received a sum of Rs.18 Lakhs from the petitioner with an assurance that they will arrange job for him, however, they failed to do so and they have not returned the money. The grievance of the petitioner is that the said complaint of this petitioner has not been attended by the respondent police. 2.Today(03.06.2025), when this writ petition is taken up for admission, Mr.A.S. Abul Kalaam Azad, learned Government Advocate (Crl.side), who takes notice for the respondents 1 to 5 submits that the complaint of this petitioner has been enquired in 2/5

CSR No.667 of 2022. Thereafter, the petitioner has lodged another complaint and the same was forwarded by the Superintendent of Police and it was assigned with C.No.148/ Tapal/ Insp/ DCB/ DGL/ 2025, wherein, summon was issued to the petitioner as well as the said Ansar Ali and Jeenath Begum. The enquiry is pending as this petitioner is not co-operating for the enquiry. 3.This Court considered the submissions made by the learned Government Advocate (Crl.side) and also perused the materials placed on record.

4.The allegations as against the respondents 4 & 5 is that under the guise of arranging a Government job to the petitioner, the proposed accused have received a sum of Rs.18 Lakhs from him. However, neither they have arranged the job, nor repaid the amount. The petitioner claims that he is having receipts for the payment made to them.

5.In view of the above, this writ petition is disposed of with a direction to the respondent police to find out the truth and take further course of action, depending upon the materials, within a period of two weeks from the date of receipt of a copy of this order. No costs.
