Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus directing respondent to consider the representation of the petitioner dated 10.06.2017 and take action against the conducting of unregistered chit by the "Kamarajar Nadar Munnetra Sangam" , Melapalayam, Tirunelveli District.

O R D E R

The petitioner seeks for a direction to the respondent to consider his representation dated 10.06.2017 and take action against the conducting of unregistered chit by the "Kamarajar Nadar Munnetra Sangam" , Melapalayam, Tirunelveli District. 2.Mr.C.Selvaraj, learned Special Government Pleader takes notice for the respondent. By consent, this writ petition is taken up for final disposal at the admission stage itself. 3.The case of the petitioner is that he is the Joint Secretary of the Society called as "Kamarajar Nadar Munnetra Sangam". He was removed from the society due to the reason that he opposed the running unregistered chit. Thereafter, a representation was sent on 10.06.2017 to take action against the conduct of unregistered chit by the society. Since no action has been taken, the present writ petition has been filed.

4.The learned counsel for the petitioner would submit that Section 4 of the Chits Act, 1983 prohibits conducting of unregistered chits and it is also a criminal offence. He would further submit that Section 83 of the above Act gives power to the https://hcservices.ecourts.gov.in/hcservices/

respondent to enter into any place and take action. Even though the petitioner sent several representations, no action has been taken. Hence, the present writ petition.

5.Considering the limited scope of the prayer sought for by the petitioner, this Court, without going into the merits of the matter, directs the respondent to consider representation of the petitioner dated 10.06.2017 and take appropriate action on merits and in accordance with law, after providing opportunity to all necessary parties, within a period of eight weeks from the date of receipt of a copy of this order.

6. With the above direction, this Writ Petition stands disposed of. No costs.
