For Respondent : Mr.E.Antony Sahaya Prabahar Government Advocate(Criminal Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.7 of 2021 on the file of the Respondent Police ORDER : The Court made the following order :- The petitioners/A2 & A3, apprehending arrest at the hands of the respondent police for the alleged offences punishable under Sections 9 and 10 of Prohibition of Child Marriage Act, 2006 and Sections 5(1) and 6 of Protection of Child From Sexual Offences Act, 2012, in Crime No.7 of 2021 on the file of the respondent police, seek anticipatory bail.

2.The learned Government Advocate (Crl.side) appearing for the respondent police would submit that the defacto complainant who is aged about 17 years was compelled to marry the first accused in this case, who is aged about 35 years old. The petitioners herein are the parents of the first accused and they have facilitated the marriage between the defacto complainant and the first accused. The victim girl with the help of her friends got the Child Help Line number and https://hcservices.ecourts.gov.in/hcservices/ 1/2

CRL OP(MD). No.11395 of 2021 informed them about the incident and immediately, the members of the Child Help Line rescued the minor victim girl. By referring the same, the earlier anticipatory bail application filed by the petitioners was dismissed by this Court in Crl.OP(MD).No.8179 of 2021 on 23.06.2021.

3.Taking note of the fact that these petitioners have forcibly facilitated the marriage for their son with the minor victim girl and since there is no change in circumstances of the case to consider the present petition, this Court is not inclined to grant anticipatory bail to the petitioners. Accordingly, this Criminal Original Petition is dismissed.
