BEFORE THE MADURAI BENCH OF MADRAS HIGH COURT DATED : 21.08.2017 CORAM :

THE HONOURABLE MR.JUSTICE T.RAJA W.P.(MD)No.14992 of 2017 and W.M.P.(MD)Nos.11823 to 11825 of 2017 M.Karuppasamy ... Petitioner Vs.

1. The Member Secretary Tamil Nadu Uniformed Service Recruitment Board, Old Commissioner of Police Office Campus Pantheon Road, Egmore,Chennai - 600 008.

2. The Chairman,/Sub Committee Tamil Nadu Uniform Services Recruitment Board, Old Commissioner of Police Office Campus Pantheon Road, Egmore,Chennai.

3. The Superintendent of Police Virudhunagar District, Virudhunagar.

... Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying for issuance of a Writ of Certiorarified Mandamus to call for the records of the 2nd respondent in his proceedings in C.No.R2/150/2017 dated 02.08.2017-e (ii) long jump and quash the same as illegal, arbitrary, violation of Principles of law and further direct the 2nd respondent to conduct a fresh test for long jumping for the petitioner.

For Petitioner : Mr.G.Marimuthu For Respondents : Mr.B.Pugazhendhi Additional Advocate General Assisted by Mr.A.K.Baskara Pandian, Special Government Pleader.

O R D E R

*********** By consent of both sides, this writ petition itself is taken up for final disposal.

2.The petitioner, having the requisite educational qualifications, applied for the post of Grade - II Police Constables / Grade-II Jail Warders / Fireman - 2017, when applications were called for by the respondent Police Department. Subsequently, after passing the written examination, the petitioner was called for for the Physical Endurance Test. https://hcservices.ecourts.gov.in/hcservices/

3.Now, the grievance of the petitioner appears to be that the respondents have wrongly disqualified the petitioner in the event of long jump, despite he jumped the requisite distance. 4.In view thereof, when the matter was earlier listed before this Court, this Court directed the respondents to produce the video recordings taken at the time of the event. 5.As per the said direction, the learned Additional Advocate General appearing for the respondent Department produced the video recordings and the same was played before me in the presence of the learned counsel on either side and also the petitioner.

6. As per the notification, a candidate should jump the distance of 3.80 meters. But a perusal of the video recording would clearly show that the petitioner was given two chances and in both the chances, the petitioner was found to be foul played. Therefore, this Court is unable to find any infirmity with the impugned order of the respondent Department.

7.In view of the above, the Writ Petition fails and the same is dismissed.

No costs.

Consequently, the connected Miscellaneous Petitions are closed.
