PRAYER: Criminal Original Petition is filed under Section 528 of BNSS Act, 2023, To call for the records pertaining to S.C.No.3 of 2025 on the file of the learned Additional District Court, Periyakulam and Quash the same in so far as the petitioner / A6 is concerned.

ORDER

The present petition has been filed by the Accused No.6 in S.C.No.3 of 2025 on the file of the Additional District Court, Periyakulam, seeking to quash the charge sheet, wherein, he is charged with the offences under Sections 147, 148, 294(b), 336, 307, 506(2), 149 of IPC and Section 3(1) of Tamil Nadu Public Property (Prevention and Damage & Loss) Act.

2. A perusal of the charge sheet reveals that the petitioner and two others, who belong to a political party, attacked the police station, damaged police vehicles, and caused injuries to the police personnel.

3. According to the learned counsel appearing for the petitioner, no specific overtact has been alleged against the petitioner herein. He further submits that the statements recorded under Section 161 Cr.P.C. do not reveal any role of the petitioner, he has been falsely implicated in the said case. He further submits that the petitioner does not belong to the said political party and he has been falsely implicated in the said case.

4. Heard the learned Counsels appearing on either side and perused the materials available on record.

5. A perusal of the charge sheet clearly reveals that the petitioner, along with two others, caused damage to the police vehicles and injuries to the police personnel.

6. In such circumstances, the role of the petitioner can be brought out only when oral evidence is let in.

7. In such circumstances, this Court does not find any merits in the present petition. Accordingly, this Criminal original Petition is dismissed. Consequently, connected miscellaneous petitions are closed. The presence of the petitioner shall be dispensed with unless specifically directed by the concerned trial Court.
